On 1 April 2015 the Disciplinary Tribunal found Mr Dean M Primmer breached:
- By-Law 9.5(b) in failing to successfully complete a Quality Review (QR) despite being selected in 2013
- Article 39(a)(ii)I of the Constitution in failing to respond to five letters from Professional Conduct in relation to a Complaint made about him in respect of his QR.
Mr Primmer did not attend the Disciplinary Tribunal Hearing.
In the interim, Mr Primmer had advised CPA Australia that he wished to relinquish his Public Practice Certificate.
Penalty and costs
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
- in relation to his failure to complete his QR, a severe reprimand
- in relation to his failure to respond to the Complaint, a severe reprimand and a fine of $2000 payable by 1 June 2015, a failure to so pay to result in forfeiture of Membership.
The Disciplinary Tribunal also ordered that:
- Mr Primmer must return his public Practice Certificate and licence and not to withdraw his request to relinquish his Public Practice Certificate
- should he withdraw his request or fail to return his Public Practice Certificate and licence and to cease all advertising and signage that he is offering public accounting services, by 1 June 2015, his membership of CPA Australia will be forfeited.
- should Mr Primmer apply for a Public Practice Certificate in the future, he must first successfully complete a compliant QR.
Mr Primmer was also ordered to pay CPA Australia’s costs of $750.84.
