On 21 April 2015 the Disciplinary Tribunal found Mr Carlos Rodriguez breached:
- By-Law 9.5(b) in failing to successfully complete a Quality Review (QR) despite being selected in August 2014
- Article 39(a)(ii)I of the Constitution in failing to respond to three letters from Professional Conduct in relation to a Complaint made about him in respect of his QR.
Mr Rodriguez attended the Disciplinary Tribunal Hearing and admitted the Complaints.
Penalty and costs
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
- in relation to his failure to complete his QR:
- a severe reprimand
- that Mr Rodriguez successfully complete a compliant QR by 31 July 2015, a failure to do so to result in forfeiture of Membership
- if Mr Rodriguez is required to undergo a follow up QR, he must pay CPA Australia costs of that Review
- in relation to his failure to respond to the Complaint, a severe reprimand and a fine of $1000 payable within 10 Business Days, a failure to so pay to result in forfeiture of Membership.
The Disciplinary Tribunal also ordered that within 10 Business Days, Mr Rodriguez provide CPA Australia with a Certificate of Currency of Professional Indemnity Insurance, a failure to so comply to result in forfeiture of Membership.
Mr Rodriguez was also ordered to pay CPA Australia’s costs of $673.60.
