On 17 April 2015 the Disciplinary Tribunal found Mr Andrew N Forster:
- breached Article 39(a)(ii)A of the Constitution in that he breached APES 110 as regards lack of independence and objectivity in auditing the accounts of a retirement village of which he was a director and shareholder and in which he had a direct financial interest
- breached Article 39(a)(ii)A of the Constitution in that he breached APES 210 in failing to comply with the Audit and Assurance standards when undertaking the audit of the retirement village.
Mr Forster was a director and secretary of the retirement village which was wound up in July 2014 with a deficiency of assets over liabilities. Mr Forster was also a creditor of the retirement village.
Mr Forster attended the Disciplinary Tribunal Hearing and admitted the Complaints.
Penalty and costs
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
- forfeiture of Membership and not eligible for readmission until 18 April 2025
- prior to any application for readmission, Mr Forster must:
- first complete the CPA Program or its equivalent
- if offering public accounting services, must first satisfactorily complete the Practice Management Program or its equivalent.
Mr Forster was ordered to pay CPA Australia’s costs of $1008.56 prior to any application for readmission to Membership.
