On 11 September 2014 the Disciplinary Tribunal found Mr William J Hamilton breached Article 39(a)(ii)F of the Constitution on two occasions in that he was ‘the subject of an adverse finding that has not been overturned on appeal in relation to the Member's conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority’ in respect of:
- a Decision and Orders of the Companies Auditors and Liquidators Disciplinary Board (CALDB) dated 3 April 2014 which suspended his registration as a liquidator for six months effective 3 June 2014
- a decision of the Australian Restructuring Insolvency and Turnaround Association (ARITA) which automatically suspended his Membership for six months effective 2 June 2014
Mr Hamilton did not attend the Disciplinary Tribunal Hearing.
