On 10 September 2014 the Disciplinary Tribunal found Mr Stephen Kwok Kan Yu:
- breached Article 39(a)(ii)A of the Constitution in that he breached By-Law 9.5(b) in failing to undertake and complete a Quality Review despite being selected in August 2012 (Complaint 1)
- breached Article 39(a)(ii)I of the Constitution in that he failed to provide a satisfactory explanation in writing and documents in support to CPA Australia in response to a Complaint made about him (Complaint 2)
Mr Yu attended the Disciplinary Tribunal Hearing and admitted the Complaints.
Penalty and costs
The Disciplinary Tribunal found the Complaints sustained and imposed the following penalties:
- in respect of Complaint 1:
- forfeiture of Membership
- that Mr Yu is not eligible for readmission to Membership until he has successfully completed a Quality Review, any follow-up Review and all assurances have been accepted
- in respect of Complaint 2, a severe reprimand.
Mr Bond was ordered to pay CPA Australia’s costs of $500.07 prior to any application for readmission to Membership.
