On 25 August 2014 the Disciplinary Tribunal determined that as set out in as set out in Article 39(a)(ii)F of the Constitution, Mr Jun Ho Lee was the subject of an adverse finding in respect decisions by the Disciplinary Tribunal of the New Zealand Institute of Chartered Accountants (NZICA) on 20 March and 6 May 2013 and the Appeals Council of NZICA on 19 July 2013.
NZICA found Mr Lee guilty of conduct unbecoming an accountant, misconduct in a professional capacity and that he had committed an act of "seriously dishonest behaviour" when attempting to gain registration as an auditor. NZICA suspended Mr Lee’s membership for 12 months and ordered he pay a penalty of $NZ5,000.
Mr Lee attended the Disciplinary Tribunal Hearing and admitted the breach.
Penalty and costs
The Disciplinary Tribunal found the Complaint sustained and imposed the penalty of forfeiture of Membership and that Mr Lee not be eligible for readmission to Membership until:
- 19 August 2015
- he has first completed the Ethics and Governance segment of the CPA Program
The Disciplinary Tribunal also determined that if Mr Lee is offering Public Accounting Services at the time of readmission to Membership, he must hold a public practice certificate recognised by CPA Australia. Mr Lee was also ordered to pay CPA Australia’s costs of $AUD678.88.
