On 20 November 2014 the Disciplinary Tribunal found Mr Frank Pagliaro breached Article 39(a)(ii)B.2) of the Constitution in that he was guilty of conduct derogatory to, or not in the best interests of CPA Australia or its Members in respect of sending two emails to a 3rd party which contained language that was offensive and unprofessional.

Mr Pagliaro attended the Disciplinary Tribunal Hearing and admitted the Complaints.

Penalty and costs 

The Disciplinary Tribunal imposed a penalty of a severe reprimand.

The Disciplinary Tribunal also ordered that Mr Pagliaro complete the Skillsnet training module PD-1187 ‘Delivering a difficult message with diplomacy and tact’ by 30 July 2015 (or such other date as agreed by the General Manager Professional Conduct), a failure to so comply to result in suspension of Membership until that module is successfully completed.

Mr Pagliaro was ordered to pay costs of $511.30.
