On 23 July 2014 the Disciplinary Tribunal determined Mr Conrad Van Dort was ‘Insolvent’ as set out in Article 39(a)(ii)E of the Constitution in that on 19 December 2013 he filed for bankruptcy.

Mr Van Dort attended the Disciplinary Tribunal Hearing and admitted the breach.

Penalty and costs 

The Disciplinary Tribunal found the Complaint sustained and imposed the penalty of forfeiture of Membership for the period of Mr Van Dort’s bankruptcy.

The Disciplinary Tribunal also ordered that prior to any application for readmission to Membership, Mr Van Dort must provide proof that full disclosure has been made to the ATO of breaches in respect of his self managed superannuation fund and that he has satisfied any ATO requirements in respect of that Fund.

Mr Van Dort was also ordered to pay costs of $670.14.
