On 14 May 2013 the Disciplinary Tribunal found Mr Yuanchao (Frank) Shen breached Article 39(a)(ii)G of the Constitution in respect of being found guilty of a breach of section 81(1) of the Crimes Act 1958 (VIC) on 21 November 2012 in the Magistrates’ Court at Broadmeadows.
The Court found Mr Shen had improperly taken unclaimed points from a loyalty rewards program from customers of his former employer, to a value of $1,000.
The Court released Mr Shen on a 2 year good behaviour bond and no conviction was recorded.
Mr Shen attended the Disciplinary Tribunal Hearing and admitted the breach.
Penalty and Costs
The Disciplinary Tribunal took into account mitigating circumstances and imposed the penalty of a severe reprimand.
