On 8 October 2013 the Disciplinary Tribunal found Mr Yoav Oren breached Article 39(a)(ii)B.2 of the Constitution in that he was "guilty of conduct which is derogatory to, or not in the best interests of the Company or its Members" in respect of five messages and/or emails sent by Mr Oren.
The emails were sent and/or copied to a former business partner with whom Mr Oren was in dispute, staff and clients of that former business partner and 3rd parties.
At the Hearing Mr Oren denied the complaints.
The Disciplinary Tribunal found the complaints sustained and that the messages/emails were offensive, threatening and unprofessional.
Penalty and Costs
The Disciplinary Tribunal handed down the following penalties:
- a severe reprimand in respect of each complaint sustained
- Mr Oren undertake and successfully complete a Quality Assurance Review by 30 June 2014, a failure to do so to result in forfeiture of Membership until completed.
The Tribunal also ordered Mr Oren pay costs of $658.97, a failure to pay those costs by the due date to result in forfeiture of Membership.
