On 4 December 2013 the Appeals Tribunal heard an appeal by Mr Peter Scioscia against a penalty imposed by a Disciplinary Tribunal on 28 August 2013.

The Disciplinary Tribunal found that Mr Scioscia had breached Article 39(a)(ii)E of the Constitution in that he was "Insolvent".

Mr Scioscia attended the Disciplinary and Appeals Tribunal Hearings and admitted the complaint.

The Disciplinary Tribunal handed down the penalty of forfeiture of Membership for the earlier of three years from the date of the Hearing or the period of Mr Scioscia’s bankruptcy, that prior to readmission he complete the CPA Program and he pay costs of $685.

Penalty and Costs

The Appeals Tribunal upheld the Determination of the Disciplinary Tribunal but varied the penalty as follows:

• forfeiture of Membership for the period of his bankruptcy
• prior to readmission Mr Scioscia successfully complete the Practice Management Program or its equivalent.

Mr Scioscia was also ordered to pay the costs of the Disciplinary Tribunal Hearing and $743.48 in respect of the Appeal Hearing.
