On 17 December 2013 the Disciplinary Tribunal found Ms Nadia Banihali was the subject of "adverse findings" in respect of a decision by the Magistrates’ Court of Victoria at Melbourne on 9 May 2013 in which Miss Banihali pleaded guilty to and was found guilty of:
- 46 counts of theft from her former employer in breach of section 74(1) of the Crimes Act
- 19 counts of falsifying documents in breach of section 83(1)(a) of the Crimes Act.
The monies were taken over a period of 20 months and totalled $132,603.
Ms Banihali was sentenced to 18 months imprisonment wholly suspended for 2 years.
Ms Banihali attended the Disciplinary Tribunal Hearing and admitted the Complaints.
Penalty and Costs
The Disciplinary Tribunal found the Complaints sustained and imposed the penalty of forfeiture of Membership for ten years from the date of the Hearing.
Further, prior to any application for readmission to Membership, Ms Banihali must first:
- successfully complete the CPA Program, but is not entitled to enrol in that Program until the expiration of eight years from the date of the Hearing
- provide a police check to CPA Australia confirming that she has had no subsequent criminal convictions, whether or not a conviction has been recorded.
Ms Banihali was also ordered to pay costs of $507.74.
