On 17 September 2013 an Appeals Tribunal considered an appeal against a Determination of a Disciplinary Tribunal handed down on 21 March 2013 in respect of Mr John Galal.
The Appeals Tribunal found Mr Galal breached Article 39(a)(ii)E of the Constitution in that on 17 April 2012 he was made bankrupt in the Federal Magistrates’ Court by way of Sequestration Order.
The Sequestration Order arose out of a court judgement in which Mr Galal was ordered to pay $551,261.67 misappropriated by him.
The Disciplinary Tribunal had imposed the penalty of forfeiture of membership for the later of four years or the period of his bankruptcy and prior to readmission he successfully complete the Ethics & Governance segment of the CPA program six months prior to any application for readmission.
Penalty and Costs
The Appeals Tribunal varied the penalty imposed by the Disciplinary Tribunal as follows:
- forfeiture of Membership and that Mr Galal not be eligible for readmission to Membership until the later of eight years from either the date of the Appeals Hearing or the period of his bankruptcy
- prior to readmission he successfully complete the CPA program
- if offering public accounting services, he first successfully complete the Public Practice program.
Mr Galal was also ordered to pay costs of $657 in respect of the Disciplinary Tribunal Hearing and costs of $724.46 in respect of his Appeal.
