On 14 August 2013 the Disciplinary Tribunal found Mr Byron Y Tan breached Article 39(a)(ii)F of the Constitution in relation to a decision of the Mortgage & Finance Association of Australia (MFAA) Tribunal on 31 January 2013 which suspended Mr Tan’s membership of the MFAA for 12 months effective 1 August 2012.
The circumstances leading to the MFAA finding was the omission of substantial liabilities in a loan application by Mr Tan for personal finance.
Mr Tan attended the Disciplinary Tribunal Hearing and admitted the complaint.
Penalty and Costs
The Disciplinary Tribunal found the complaint sustained and imposed the penalty of:
- a severe reprimand
- that Mr Tan’s status be lowered from FCPA to CPA
- that Mr Tan successfully complete the Ethics & Governance segment of the CPA program by 30 December 2014, a failure to do so to result in forfeiture of membership until completed.
Mr Tan was also ordered to pay costs of $674.
