On 12 June 2013 the Disciplinary Tribunal found Brett S Purchase breached Article 39(a)(ii)B.2) of the Constitution in that he engaged in "conduct which is derogatory to or not in the best interests of the Company or its Members":
- in providing two written legal advices to a client when he was not a legal practitioner and not authorised to provide such advices under the Legal Profession Act 2004
- in presenting those advices as his own when the advices had been prepared by others.
Mr Purchase attended the Disciplinary Tribunal Hearing and denied the complaints.
Penalty and Costs
The Disciplinary Tribunal found the complaints sustained and imposed the penalty of:
- a severe reprimand
- that Mr Purchase satisfactorily complete the Practice Management program by 30 December 2014, a failure to do so to result in suspension of membership until completed.
Mr Purchase was also ordered to pay costs of $936.
