On 8 October 2013 the Disciplinary Tribunal found Mr Au Ping Lam breached Article 39(a)(ii)F of the Constitution in that he has "been the subject of an adverse finding that has not been overturned on appeal in relation to the Member's conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction" in respect of a Decision and Orders of a Disciplinary Committee of the Hong Kong Institute of Certified Public Accountants (HKICPA) dated 16 January 2013.
The HKICPA found Mr Au had breached Section 34(1)(a)(vi) of the Professional Accountants Ordinance in that he had failed or neglected to observe, maintain or otherwise apply a professional standard, HKFRS for Private Entities (30 April 2010 Issue) and HKSA 500 in failing to obtain sufficient appropriate audit evidence to be able to draw reasonable conclusion on which to base his audit opinion during his 2010 audit of a Public Listed Entity.
HKICPA reprimanded Mr Au, ordered he pay a penalty of HK$46,000 and costs of HK$59,882.
At the Hearing Mr Au attended by teleconference and denied the complaint.
The Disciplinary Tribunal found the complaint sustained.
Penalty and Costs
The Disciplinary Tribunal handed down the following penalty and costs:
- a severe reprimand
- that Mr Au pay costs of AU$521.75, a failure to pay those costs by the due date to result in forfeiture of Membership.
