On 16 January 2013 the Disciplinary Tribunal found Mr Andy Y Choy breached Article 39(a)(ii)F of the Constitution in that he has "been the subject of an adverse finding that has not been overturned on appeal in relation to the Member's conduct, competence or recognition by any Court, professional body, statutory or other regulatory authority in any jurisdiction" in respect of a decision of the Hong Kong Institute of Certified Public Accountants (HKICPA) on 2 December 2011 which ordered that Mr Choy’s name be removed from the register of certified public accountants for a period of two years effective 16 January 2012.
The HKICPA considered a Magistrate’s Court decision in June 2004 in which Mr Choy was convicted of three counts of providing false information to the Securities and Futures Commission. HKICPA determined that these were offences involving dishonesty.
Mr Choy did not attend the Disciplinary Tribunal Hearing but admitted the breach.
Penalty and Costs
The Disciplinary Tribunal imposed the sanction of:
- forfeiture of Membership for two years commencing 16 January 2012
- that immediately prior to readmission Mr Choy completes the Ethics & Governance Segment of the CPA Program.
Mr Choy was also ordered to pay a contribution towards CPA Australia’s costs of AU$516.
