On 30 August 2012 the Appeals Tribunal considered an appeal against the sanction imposed by a Disciplinary Tribunal handed down on April 2012 in which it was found that Mr Victor Turco breached Clause 27(1 )(f) of the former Constitution in that he was Insolvent, and his membership was forfeited for the later of 12 April 2013 or the period of Mr Turco’s bankruptcy.
At the Hearings Mr Turco admitted the breach.
The Appeals Tribunal confirmed the comments of the Disciplinary Tribunal that continued membership of CPA Australia is inconsistent with a member being bankrupt.
The Appeals Tribunal considered fresh submissions made by Mr Turco on the day, noting that he came out of bankruptcy on 20 June 2012.
Penalty and Costs
The Appeals Tribunal varied the sanction imposed by the Disciplinary Tribunal and ordered that Mr Turco’s period of forfeiture be from the date of the Disciplinary Tribunal Hearing to 30 August 2012.
Mr Turco was also required to contribute $746 to the costs of the Disciplinary Tribunal Hearing and $789 costs in respect of the Appeals Tribunal Hearing.
