On 15 March 2012 the Disciplinary Tribunal found a Member breached:
- By-Law 9 in that since 2007 (and possibly since 2002) the Member was offering Public Accounting Services without holding a Public Practice Certificate
- By-Law 9 in that the Member had never held a policy of professional indemnity insurance (Pll).
On 4 March 2011 the Member signed an undertaking to procure Pll, complete the CPA Program, the Public Practice Program and obtain a CPA Australia Public Practice Certificate. Whilst the Member obtained Pll, he failed to honour the rest of the undertaking and on 9 February 2011 the Member procured a Professional Practice Certificate from the Institute of Public Accountants (IPA).
Penalty and Costs
The Disciplinary Tribunal imposed a penalty of forfeiture of Membership and costs of $575.
However owing to exceptional circumstances, the Tribunal allowed the Member the opportunity to resign within 30 days, a failure to do so to result in forfeiture of Membership.
Should the Member make application for readmission following his resignation of if his Membership is forfeited, it is a condition of readmission that the Member first complete the CPA Program or its equivalent as a non Member and pay CPA Australia’s outstanding costs.
