On 3 April 2012 the Disciplinary Tribunal found Mr Mario Turco breached Clause 27(1 )(f) of the former Constitution in that he was Insolvent.

At the Hearing Mr Turco admitted the breach.

The Disciplinary Tribunal noted that continued membership of CPA Australia is inconsistent with a member being bankrupt, at least for the period of bankruptcy.

Penalty and Costs

The Disciplinary Tribunal imposed the sanction of forfeiture of Membership for the later of 12 April 2013 or the period of Mr Turco’s bankruptcy

The Tribunal determined that Mr Turco contribute $746 to the costs of the Hearing.

The Tribunal also determined that prior to any application for readmission Mr Turco must meet the requirements of Article 2 of the Constitution if he is offering public accounting services.
