On 29 March 2012 the Appeals Tribunal heard an appeal from Mr Douglas Witham against a determination of a Disciplinary Tribunal handed down on 23 November 20 11 which found Mr Witham had breached Article 39(a)(ii)E of the Constitution in that on 20 July 2 010 he became “Insolvent”
At the Hearing Mr Witham admitted the Complaint.
The Appeals Tribunal upheld the sanction imposed by the Disciplinary Tribunal as follows:
Penalty and Costs
- forfeiture of membership and that Mr Witham is not eligible for readmission until the expiration of his bankruptcy
- within 30 days Mr Witham must remove all CPA signage and logos from his place of practice
- within 30 days Mr Witham must return all CPA Australia membership certificates and licences
- Mr Witham pay costs of $845 for the Disciplinary Tribunal Hearing and costs of $691 in respect of the Appeal Hearing prior to any application for readmission to membership.
