On 9 June 2011 the Disciplinary Tribunal found a Member breached Clause 27(1 )(a) of the former Constitution and Article 39(a)(ii)A of the Constitution in that the Member breached former By-Law 702.2 and By-Law 9.1 in offering Public Accounting Services whilst of Associate status without being the holder of a CPA Australia Public Practice Certificate.
The Tribunal noted that since March 2005 the Member had held an NIA public practice certificate, which was not recognised by CPA Australia in the By-Laws until 1 January 2010.
The Member had also improperly used the post-nominal ASACPA on his correspondence.
The Tribunal handed down the following penalty and costs:
- forfeiture of Membership, and
- costs of $617.
The Tribunal took into account “exceptional circumstances", and ordered that the Members name not be disclosed.
