On 10 August 2011 the Disciplinary Tribunal found a Member breached Article 39(a)(ii)l of the Constitution in that the Member "failed to comply with any reasonable and lawful direction of the Board or its delegate which relates to the good order and administration of the Company...” in failing to respond to correspondence from CPA Australia in relation to the Member’s Quality Assurance Review.
Penalties and costs
The Disciplinary Tribunal imposed the following penalties and costs:
a severe reprimand, and
costs of $561, a failure to pay the costs within 30 days of receipt of invoice to result in forfeiture of Membership.
The Disciplinary Tribunal took into account “exceptional circumstances”, including the Member’s genuine remorse and distress, and personal matters and ordered that the Members name be withheld from publication. However should the Member have any complaints sustained by a Disciplinary Tribunal within the next two years, then the Member’s name will be disclosed.
